UPDATE – FMCSA Proposed Regulations Regarding Drug and Alcohol Clearinghouse

As DATIA reported last week, the FMCSA announced a Notice of Proposed Rulemaking (NPRM) to establish the Commercial Driver’s License Drug and Alcohol Clearinghouse (Clearinghouse), a database under the Agency’s administration that will contain controlled substances (drug) and alcohol test result information for the holders of commercial driver’s licenses (CDLs). At that time, the notice had not yet been officially published, and a due date for comments was unavailable. FMCSA Proposes National Drug and Alcohol Testing Clearinghouse for Commercial Truck and Bus Drivers

 Employers would be required to check clearinghouse before hiring and annually

WASHINGTON – The U.S. Department of Transportation’s Federal Motor Carrier Safety Administration (FMCSA) today announced a proposed rule to establish a drug and alcohol clearinghouse for all national commercial driver’s license (CDL) holders. The clearinghouse would help improve roadway safety by making it easier to determine whether a truck or bus driver is prohibited from operating a commercial motor vehicle for failing to comply with federal drug and alcohol regulations, including mandatory testing.
