Occupational Health Groups to Study Workplace Marijuana Use

The American Association of Occupational Health Nurses (AAOHN) and the American College of Occupational and Environmental Medicine (ACOEM) have announced they will collaborate to study workplace health and safety issues associated with worker impairment from the use of marijuana and other drugs.

Citing changing societal attitudes toward marijuana, including its increasing use for medicinal purposes and new state-decriminalization laws, ACOEM and AAOHN leaders said the occupational health profession can play an important role in helping the U.S. workplace prepare for the potential impacts of these trends. National Database on Positive Drug & Alcohol Tests Closer to Reality

After years of prodding from employers and a Congressional mandate, the Federal Motor Carrier Administration (FMCSA) has issued a rulemaking to establish the Commercial Driver’s License Drug and Alcohol Clearinghouse. The clearinghouse, as proposed would collect verified positive, adulterated, and substituted drug test results as well as refusals and negative return-to-duty test results. Read more

Random Drug Testing for All

Random drug testing of non-safety sensitive employees helps employers identify individuals who have a substance abuse problem while at the same time deterring others from starting or continuing to use drugs.

More companies are conducting random testing according to one national study. In 2011, 47 percent of employers indicated that they conduct random testing compared to 46 percent in 2010 and 39 percent in 2006. The study was conducted by the Society for Human Resource Management (SHRM) in conjunction with the Drug and Alcohol Testing Industry Association (DATIA). Read more

FMCSA Shuts Down Two Carriers for Inspection, Drug Testing, Hours Violations

The Federal Motor Carrier Safety Administration (FMCSA) announced in mid-March it had shut down two separate trucking companies, issuing both imminent hazard out-of-service orders for various violations including failure to comply with alcohol and drug use and testing policies.

GEG Construction, Inc., in Indian Orchard, Mass., and its owner Gil comes were found to have failed to have in place proper systems for truck inspections, repairs or maintenance, and the fleet operated trucks in “out-of-service condition,” FMCSA says. The company also allowed drivers to operate vehicles before receiving drug and alcohol test results, FMCSA says. Read more

UPDATE – FMCSA Proposed Regulations Regarding Drug and Alcohol Clearinghouse

As DATIA reported last week, the FMCSA announced a Notice of Proposed Rulemaking (NPRM) to establish the Commercial Driver’s License Drug and Alcohol Clearinghouse (Clearinghouse), a database under the Agency’s administration that will contain controlled substances (drug) and alcohol test result information for the holders of commercial driver’s licenses (CDLs). At that time, the notice had not yet been officially published, and a due date for comments was unavailable. The notice was published in the Federal Register yesterday, and the official due date for comments is April 21, 2014. View the official NPRM. Read more

FMCSA Proposes National Drug and Alcohol Testing Clearinghouse for Commercial Truck and Bus Drivers

 Employers would be required to check clearinghouse before hiring and annually

WASHINGTON – The U.S. Department of Transportation’s Federal Motor Carrier Safety Administration (FMCSA) today announced a proposed rule to establish a drug and alcohol clearinghouse for all national commercial driver’s license (CDL) holders. The clearinghouse would help improve roadway safety by making it easier to determine whether a truck or bus driver is prohibited from operating a commercial motor vehicle for failing to comply with federal drug and alcohol regulations, including mandatory testing. USDOT’s Drug and Alcohol Testing Clearinghouse Rule Cleared by OMB

A new federal mandated rule that would implement a national driver database detailing drivers’ history of failed or refused drug and alcohol tests has been approved by the White House’s Office of Management and Budget (OMB) on January 27. Read more

Q: So what are the exact rules about documents you need to maintain for your drug program?

A: Within the regulations CFR 49 Part 382, it clarifies that: MIS REPORTS: Subpart D – Handling of test results, records retention, and confidentiality, §382.403 Reporting of results in a management information system.

(a) An employer shall prepare and maintain a summary of the results of its alcohol and controlled substances testing programs performed under this part during the previous calendar year, when requested by the Secretary of Transportation, any DOT agency, or any state or local officials with regulatory authority over the employer or any of its drivers. Motor Carrier Alliance Wants Hair Testing OK’d for DOT Driver Drug Screening

Prompted by a few large trucking interests, Sen. Mark Pryor, D-Ark., and Rep. Rick Crawford, R-Ark., have introduced federal legislation designed to enable trucking companies to more effectively prevent lifestyle drug users from gaining employment as commercial truck drivers.

Companion bills in the Senate and House direct the Department of Health and Human Services (DHHS) to recognize hair testing as an optional method to comply with the Department of Transportation drug testing requirements for truck drivers. Read more
